POLICY [Surveillance] Luhan (Aff) vs lolwut5 (Neg)

Recommended Posts

Advantage 1

Your Fakhoury ev says that local & state police/law enforcement are using Stingray. Do you have any evidence that indicates the federal government is using Stingray?

If you are so concerned about surveillance, why not turn off your cellphone?

Why does it matter that the government can find you if companies are already tracking you?

Your Courtright/Diamond evidence is about global democracy. Why does addressing the Fourth Amendment in the U.S. spillover?

Advantage 2

Your Calabrese and Fulton ev says

In just one year, Sprint Nextel provided law enforcement agencies with the specific whereabouts of its customer more than 8 million times without requiring a warrant or probable cause.

How does the plan stop companies giving over the information?

The Supreme Court has ruled that warrantless searching of cell phones is unconstitutional. Why doesn't this solve the aff?

Advantage 1

Your Fakhoury ev says that local & state police/law enforcement are using Stingray. Do you have any evidence that indicates the federal government is using Stingray?

Extend my first card, ACLU 14 which says that "Federal, state and local law enforcement agencies have been using ISMI catchers ..." and if that doesn't hold, extend my Klonick 14 which states, "And like the federal government, local police are using this technology without any judicial oversight." which states that local and state governments are following along with what the federal government is already doing (using Stingray devices without judicial oversight) in the status quo.

If you are so concerned about surveillance, why not turn off your cellphone?

In the 21st century, our most of our society has grown vastly dependent on cellular technology. It's not easy to simply just "quit" using cellphones entirely. This large dependency puts many at risk to the searching and seizing of cellular data.

Why does it matter that the government can find you if companies are already tracking you?

It's impossible to completely stop the government from finding us, but making it harder by limiting their usage of tools in which surveillance can be conducted is the only option we have.

Your Courtright/Diamond evidence is about global democracy. Why does addressing the Fourth Amendment in the U.S. spillover?

Preserving our privacy rights and our own constitution is essential for our democratic system, and those two cards aren't about a global democratic system, but applies to democracy in general where the US could be used as an example where strong democracy allows greater peace and less war. If we stop violating our own amendments, we can continue in a democratic fashion.

Advantage 2

Your Calabrese and Fulton ev says

In just one year, Sprint Nextel provided law enforcement agencies with the specific whereabouts of its customer more than 8 million times without requiring a warrant or probable cause.

How does the plan stop companies giving over the information?

As stated again, we can't completely stop the government from holding our location in any means accessible, but we can make it harder for them to do so by limiting their usage of tools in which they can spy on us from.

The Supreme Court has ruled that warrantless searching of cell phones is unconstitutional. Why doesn't this solve the aff?

Because law enforcement are still using the devices. A court ruling WILL NOT solve for our Affirmative. Our actor, the FCC is the best way to solve because they will provide strict de-authorization, rather than a ruling.

Sorry for the edit. I saw a typo and felt the need to edit it, but the answers to questions remain the same.

Topicality

If surveillance isn't being conducted by law enforcement, then who truly operates it?

Did you bring any voters or was that part of your grounds, extra-T, etc.?

Legalism

Can you explain your Kritik in your own words?

Define "necropolitics"?

What's the link to the case?

How does our plan lead to, "a permanent battle-space, continues violent exploitation of the global South"?

What does your Alt solve for?

On-case

How does democratic peace lead to structural violence?

Your Glennon 14 card, which officials are being granted "legitimacy"? What is that stating about our plan?

Explain your Schlag 13 card?

Topicality

If surveillance isn't being conducted by law enforcement, then who truly operates it?

The Bowling ev draws a distinction between the NSA and FBI who monitor the general population in order to identify anomalies in patterns ie. if I send an email with certain words I will be watched more closely, versus law enforcement investigations which already suspect a crime being committed and investigate it further.

Did you bring any voters or was that part of your grounds, extra-T, etc.?

? T is a voting issue to set the best interpretation of the topic, the standards debate impacts that out

Legalism

Can you explain your Kritik in your own words?

The simulation of legal reform is used as evidence of the West's self-reflexivity which sidelines questions of its legitimacy. The impact is limitless violence. The alternative is a communal response to that surveillance which questions the legitimacy of the state and refuses its justifications of 'security' and 'protection.'

Define "necropolitics"?

When sovereignty is explicitly concerned with choosing disposable populations to eliminate.

What's the link to the case?

There are multiple, I will expound on them a bit in the block

-legalism link - comaroff discusses how all the tribunals in the West post-colonialism are used as guilt assuasion to strengthen the legitimacy of lawfare

-state focus link - smith discusses how a focus on curtailing state surveillance elides a focus on the state itself and the colonial, patriarchal logics that structure it

-tech focus link - puar discusses how a focus on top down panoptic surveillance ignores how technology has become communal and intimate, these networks of control contribute to militarism

-national security reform link - glennon discusses how the aff is a lot like the fbi trials of the 70s - it doesn't really shift power around in the intelligence apparatus but it gives the illusion of reform to prevent public inquiry

-democracy link - kiely discusses how the us has never been committed to democracy, only to exploitation, and the diamond ev's strong claims about democracy create a good v. evil struggle which causes conflict

-progress link - wilderson discusses how ending one form of police surveillance is used to further a nationalist narrative of progress but leaves the positionality of the black as slave intact

and then of course schlag - who says any 2ac simulation offense has no impact because the arguments we make here are insulated

How does our plan lead to, "a permanent battle-space, continues violent exploitation of the global South"?

that kind of begs the question of the links which i outlined above

What does your Alt solve for?

we make a competitive argument about how we as individuals and communities can solve the case while also curtailing the state, smith ev is really fantastic on this question

On-case

How does democratic peace lead to structural violence?

the idea countries will model our democratic norms hides the way we are responsible for a lot of the autocracy and violence of the world - kiely ev

Your Glennon 14 card, which officials are being granted "legitimacy"? What is that stating about our plan?

the 70s trial example i talked about above really speaks to the way single issue reforms don't address a broken system but make it more insidious

Explain your Schlag 13 card?

schlag in *3, in short he says that no policy education as a result of this debate we garner matters
