Let me clarify. Judge Thompson was not drawing the line between private and government displays. He was trying to draw a line between some govt displays and other govt displays thus my question as to what determines where the line is drawn with respect to govt displays that are constitutional and ones that are not constitutional in his mind.

 

As long as a religious display by a government has a "substantial secular purpose," the display doesn't violate the Establishment Clause. Obviously, the issue is whether or not there is a secular purpose to having the 10 commandments displayed...Again, if you're really curious, I highly recommend reading the briefs (or the transcript of the oral argument, which I assume will be posted shortly). The briefs are relatively short and fairly easy to read...
